San Diego's short-term rental (STR) landscape has evolved significantly with the introduction of new regulations. Whether you're a current host or considering entering the STR market, understanding the rules is essential for operating legally and profitably.
In 2022, the City of San Diego implemented a new STR ordinance that established a tiered licensing system. The tiers are: Tier 1 (home-sharing, renting a room in your primary residence while you're present), Tier 2 (whole-home rental of your primary residence while you're away), and Tier 3 (whole-home rental of a non-primary residence, i.e., investment properties).
Tier 3 licenses, which apply to most investment properties, are capped at a specific number based on the city council district. This cap means that not all applicants will receive a license, and there may be a waitlist. It's important to check availability in your district before investing in an STR property.
All STR operators must obtain a Transient Occupancy Tax (TOT) certificate and collect TOT from guests, which is currently 10.5% in the City of San Diego. Additionally, a 2% Marketing District Assessment may apply. Platforms like Airbnb and VRBO may collect and remit these taxes on your behalf, but it's your responsibility to verify.
Licensing requirements include: a valid city STR license, a business tax certificate, proof of insurance, and compliance with noise, parking, and trash regulations. Hosts must also designate a local responsible party who can respond to issues within 60 minutes, 24/7.
Non-compliance can result in significant fines, license revocation, and even legal action. The city actively monitors STR platforms for unlicensed listings and has a dedicated enforcement team. Make sure your listing displays your license number as required by law.
